The City of New York had repaved the roadway on Madison A venue and left the roadway in a condition where it was sloped downward and the roadway was much lower stepping off the curb than usual. The client, a woman in her mid-60’s, stepped from the curb onto the roadway and because of the steep drop to the roadway and the sloping of the roadway, her right foot landed on the roadway on an angle causing her body to fall to the right. She fractured her hip and underwent hip replacement surgery. We sued the City of New York for causing and creating a dangerous and unsafe condition by repaving the roadway in an improper and unsafe manner. After extensive litigation, the City of New York agreed to settle the case for $1.9 million.
